By accessing or using GLASS (“the Service”), operated by GLASS Inc. (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these Terms at any time; continued use after changes constitutes acceptance.
GLASS is a market intelligence platform for the regulated cannabis industry. The Service collects publicly available retail menu data, pricing information, and lab results (“COAs”) from dispensary websites and aggregator platforms across Massachusetts, Connecticut, and New York. We process this data to provide brand and distribution teams with daily market reports, alerts, and analytics.
You must be at least 21 years old and authorized to operate in the regulated cannabis industry to use the Service. By creating an account, you represent that you meet these requirements and that all registration information you provide is accurate and current.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Each seat is licensed to a single individual and may not be shared. You must notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.
You agree not to: (a) redistribute, resell, or sublicense GLASS data or reports without written permission; (b) use the Service to violate any applicable law or regulation; (c) reverse-engineer, scrape, or extract data from the Service by automated means; (d) interfere with or disrupt the Service or its infrastructure; (e) use the Service for any purpose unrelated to legal cannabis business operations.
All data, reports, analytics, and visualizations provided through the Service are derived from publicly available sources and proprietary processing. We make reasonable efforts to ensure accuracy but do not guarantee that data is error-free, complete, or current. You acknowledge that retail menu data changes frequently and that our data reflects a point-in-time snapshot.
The Service, including its design, software, data models, processed datasets, and branding, is owned by GLASS Inc. and protected by intellectual property law. Your subscription grants a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes during the subscription term.
Paid plans are billed monthly or annually as selected at sign-up. All fees are non-refundable except as required by law. We may change pricing with 30 days' notice. Failure to pay may result in suspension or termination of access.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL BE ACCURATE OR COMPLETE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLASS INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless GLASS Inc., its officers, directors, and employees from any claims, losses, or damages arising from your use of the Service, your violation of these Terms, or your violation of any applicable law.
Either party may terminate a subscription at the end of the current billing period. We may suspend or terminate your access immediately if you violate these Terms. Upon termination, your right to use the Service ceases and we may delete your account data after a reasonable retention period.
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in Suffolk County, Massachusetts.
